German authorities investigate Facebook activities related to Oculus VR headsets

German authorities began checking Facebook on the legality of its decision on the mandatory use of an account on a social network for Oculus headset owners for authorization. By its actions, Facebook can violate several German laws on fair competition in the market.

The social network Facebook is very popular in Germany, according to Andreas Mundt, head of the German Federal Cartel Supervision Authority. In addition, the company is one of the leading players in the developing virtual reality market. The agency will check whether Facebook’s actions are not an abuse of its dominance.

“We will conduct an investigation, during which we will find out to what extent this requirement can negatively affect competition in these areas,” commented Mr. Mundt.

When asked for comments from The Associated Press, Facebook replied that it had previously suspended sales of Oculus virtual reality headsets in Germany. The company did not explain the reason for this decision, but at the same time confirmed that it was not related to the antitrust investigation that began this Thursday.

Recall that earlier Facebook changed its policy regarding the use of virtual reality headsets Oculus, introducing a requirement for the presence and use of an account on the social network for authorization of the headset. The first headset to meet this requirement was the recently released Oculus Quest 2. All subsequent Oculus VR devices will be subject to the same requirement. In addition, owners of current VR devices need to merge independent Oculus accounts with social media accounts by January 2023.

By the way, these are not the first claims of the German authorities to Facebook. Last year, the same agency accused the company of exploiting its dominance in the targeted advertising market. Facebook has a policy of forcing users to share personal data with its other platforms, including WhatsApp and Instagram, as well as with third parties through the “Like” and “Share” buttons. Following the results of the trial, the companies were given several months to stop collecting data about users without their consent. Facebook appealed this decision in the Dusseldorf court, which sided with the social network.

In June this year, the German Federal Supreme Court overturned the Düsseldorf court ruling. He agreed with the arguments of the Federal Office for Supervision of Cartels and pointed out that by its actions Facebook “does not leave the choice of private users of the social network.”. The company was obliged to comply with the requirement of the regulator. It is noted that the main litigation in Dusseldorf is still ongoing. Facebook insists it will continue to defend its interests and does not agree to violate any fair market laws. It also indicates that the company still did not comply with the requirements of the Federal Office for the Supervision of Cartels. A hearing in this case is scheduled for March 26 next year.

A new investigation by the German authorities became known literally a day after the American antitrust regulators sued Facebook for what they believed to be abusing its market power. The tech giant has taken over the dominant position in the social media segment by purchasing Instagram and the messaging service WhatsApp.
