New EU data exchange rules could create problems for Russian services

The draft of a new regulation on data management developed by the European Commission (EC) may create problems for Russian digital services providing services abroad, writes Kommersant, citing the opinion of interviewed experts.

The project, published on the EC website on November 25, aims to increase the availability of data for business and research, taking into account consumer protection under the General Data Protection Regulation (GDPR) of 2021. On the other hand, the project introduces restrictions on the transfer of information to countries where the level of data protection does not meet European standards. These include, in particular, Russia and the United States.

“Only the European offices of Russian companies will be able to participate in the exchange, which will have access to arrays of useful data, but will not be able to freely share them with the headquarters,” explains Alexander Zhuravlev, chairman of the commission on legal support of the digital economy of the Moscow branch of the Russian Lawyers Association.

According to the new regulation, there are two types of data management: commercial and gratuitous. Commercially important user data in a protected form and format will be allowed to be shared only through an independent intermediary.

In such an exchange, according to Zhuravlev, Russian digital services are interested in providing services abroad, including postal and gaming services available to Europeans – Yandex and Mail.ru Group, Aviasales and OneTwoTrip, air carriers, marketplaces, including Wildberries and Ozon, medical services, as well as companies working in the field of artificial intelligence and big data.

In response to a request to comment on the new regulations, Kaspersky Lab noted that the EC’s proposal could be changed. However, the company has already moved the infrastructure for processing and storing data of European users to Switzerland, which has an agreement with the EU to recognize an adequate level of protection of personal data.

For Russian companies intending to conduct international business and interested in exchanging data with the EU, the adoption of the regulation may entail a number of restrictions, said the executive director of the Big Data Association (which combines Yandex, Mail.ru Group, Sberbank, Gazprombank, Tinkoff-Bank, MegaFon, Rostelecom, VimpelCom, etc.) Alexey Neiman. He clarified that even now Russian companies do not have such an opportunity, since Russia is not included in the list of countries that guarantee an appropriate level of data protection under the GDPR. Therefore, now cross-border exchange takes place in the form of reports, that is, ready-made analytical products, and not the data itself.
